TTerms and Conditions of Finca Luz Fuerteventura

1. Introduction

These General Conditions regulate the use of the website www.fincaluz.com (hereinafter the “Website”) and the services offered by Finca Luz Fuerteventura, owned by Canarias Yacht Master SL (hereinafter the “Establishment”). The use of the Website implies full and unreserved acceptance of all the provisions included in these Terms and Conditions. If you do not accept any of these conditions, we invite you not to use the Website.

3. Terms of Use of the Website

3.1. Access and Use

• Access to the Site is free and open, except for the cost of the connection to the telecommunications network provided by the access provider chosen by the user.
• The user undertakes to use the Site in accordance with the law, morality, generally accepted good customs and public order.
• It is prohibited to use the Site in a way that violates these Conditions or the rights of third parties.

3.2. Contents and Services

• The user undertakes not to use the contents of the Site for illicit purposes or purposes contrary to good faith and public order.
• It is prohibited to disseminate content or propaganda of a racist, xenophobic, pornographic nature, in favor of terrorism or against human rights.

3.3. Intellectual Property

• All the contents of the Site (texts, images, graphics, drawings, software, logos, etc.) are the exclusive property of Canarias Yacht Master SL or its licensors.
• The contents are protected by Spanish and international laws on intellectual and industrial property.
• The reproduction, distribution, public communication or transformation, in whole or in part, of any content on the Site is prohibited without the express written authorization of Canarias Yacht Master SL.

4. Booking and Service Conditions

4.1. Bookings

• To make a booking, the user must complete the online forms on the Site.
• All bookings are subject to the availability of accommodation and confirmation by Finca Luz Fuerteventura.

4.2. Prices and Payments

• The prices indicated on the Site are expressed in Euros and include VAT, unless otherwise indicated.
• Bookings and payments are managed through the service providers Kross Booking and Stripe.
• Upon confirmation of the booking, payment of the total amount or a deposit will be requested, according to the methods indicated during the booking process.

4.3. Inclusions in the Price of the Stay

The price of the stay includes:

• All applicable taxes.
• Breakfast (available in the morning from 8:00 to 10:00).
• Normal consumption of water and electricity.
• Towels, sheets and accessories such as TV and air conditioning.
• Kitchen utensils and dishes (where provided, for example, in the One Bedroom La Casa apartment).

4.4. Exclusions from the Price of the Stay

The price of the stay does not include:

• Extra activities not selected during the booking phase.
• Additional services requested during the stay, which must be paid directly at the Facility.
• Any service not explicitly indicated in the section “Inclusions in the Price of the Stay”.

4.5. Maximum Capacity and Conditions of the Rooms

• The maximum occupancy of a room cannot exceed two people in a double bed (single beds are not available).
• People under 12 years of age are not allowed.
• Animals of any type or size are not allowed.
• The Facility reserves the right to deny access in the event of discrepancies in the number of guests, age or presence of animals without refund of the amount paid.
• The tourist undertakes to return the room in the condition in which it was left, except for cleaning at the expense of the Facility.
• It is necessary to follow the instructions for use provided by the Facility and maintain a behavior respectful of the peace and other guests.
• Failure to comply with these rules may result in the removal of guests without compensation and the collection of any damages caused.

4.6. Arrival at the Facility and End of Stay

• It is required to communicate the estimated time of arrival to the Facility.
• The keys to the Facility and the room will be delivered to guests upon their arrival.
• The keys must be returned to the Facility at the end of the stay by the scheduled check-out time.

4.7. Cancellations and Changes

• Cancellations or changes to reservations must be communicated exclusively in writing via email to [email protected].
• The cancellation conditions, including the penalties provided, are indicated at the time of booking according to the following policies:
Cancellation Policies:
1. Stays Purchased with a Non-Refundable Rate:
• Cancellation entails the total loss of the amount of the stay.
• The Facility may retain the amount already paid or charge the customer's credit/debit card.
2. Stays Purchased with a Refundable Rate with Terms:
• The customer can cancel the reservation without penalty within 10 days of the expected start date of the stay (check-in date).
• In the event of a subsequent cancellation, i.e. less than 10 days from the expected check-in date, the Facility will retain the entire deposit or amount of the stay paid as a penalty.
• In general, failure to show up for check-in, renunciation during the stay on the following days or cancellation after the deadline will result in the loss of the amount paid or the charge to the credit card of the amount of the entire stay, as well as the total or residual cancellation of the reservation.

5. Data Protection Policy

• The personal data provided by the user during the reservation process and use of the Site will be treated in accordance with our Privacy Policy.
• The data relating to reservations and payments are managed through the service provider Kross Booking and Stripe.

6. Responsibility

6.1. Exclusion of Liability for the Content

• Canarias Yacht Master SL will not be liable for any errors or omissions in the contents of the Site.
• It is not liable for any damages arising from the use of the Site or the contents published therein.

6.2. Disclaimer for the Operation of the Site

• Canarias Yacht Master SL does not guarantee that the Site will operate uninterruptedly or without errors.
• Under no circumstances will Canarias Yacht Master SL be liable for any damages arising from access to and use of the Site.

7. Modifications to the Terms and Conditions

• Canarias Yacht Master SL reserves the right to modify these General Conditions at any time and without prior notice.
• The modifications will be published on the Site and will be effective from the date of their publication.
• Continued use of the Site after the publication of the modifications implies acceptance of the same.

8. Applicable Law and Jurisdiction

• These Conditions are governed by Spanish law.
• For any dispute relating to the interpretation or application of these Conditions, the parties submit to the exclusive jurisdiction of the courts of Las Palmas, Spain.
